These Terms & Conditions ("Terms") govern your access to and use of Sitely ("Sitely", "we", "us"), an AI-powered website builder available at this website (the "Service"). Sitely is a trading name of Bouchra Khalifa, an individual entrepreneur based in Spain ("the Seller"). Bouchra Khalifa, trading as Sitely, is the party you contract with when you use the Service. You can contact us at any time through the support channels available on this website.
1. Acceptance of these Terms
By creating an account, purchasing a plan or credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. Continued use of the Service after any change to these Terms constitutes acceptance of the changed Terms.
2. Eligibility and accounts
- You must be of legal age to form a binding contract, or have your legal guardian's consent, and you must have authority to bind any organization you represent.
- You must provide accurate information when registering and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. The Service
Sitely generates and edits websites from your text prompts using artificial intelligence. Access is provided through plans and credits as described on our pricing page. We may change, add or remove features of the Service over time.
4. Acceptable use
You must not misuse the Service. You must not:
- use the Service for any unlawful purpose, including fraud, spam or phishing;
- infringe the intellectual property or other rights of any third party;
- interfere with the security of the Service, including introducing malware, probing or scanning vulnerabilities, or scraping the Service;
- use the AI generation features to create illegal content, non-consensual or harmful deepfakes, hate speech, malware, or to attempt to bypass or "jailbreak" the safety controls of the Service;
- reverse engineer the Service, resell or redistribute it, or circumvent technical limits such as credit allowances or rate limits;
- share account credentials or make the Service available to others under your account.
These rules also apply to every website you build, publish or host with the Service and to what its visitors can do there. You must not publish sites that:
- impersonate another person, brand or organisation, or are designed to collect passwords, payment card details or other sensitive data by deception (phishing);
- offer illegal goods or services, including drugs, weapons, counterfeit goods or unlicensed gambling;
- contain sexual content involving minors, non-consensual intimate imagery, or content that promotes violence, terrorism, harassment or hatred;
- distribute malware, run cryptocurrency mining in visitors' browsers, or send unsolicited bulk messages;
- process visitors' personal data unlawfully or without the notices and consents required by applicable law.
We may unpublish any site or remove any content that breaches these rules, and you are responsible for the content of the sites you publish and for complying with laws that apply to them.
5. AI-generated content
- You are responsible for the prompts you submit, how you use the generated output, and for verifying the accuracy of any output before you rely on or publish it.
- You confirm that you have the necessary rights to any content you input to the Service.
- AI output may be inaccurate or incomplete and is not professional advice (legal, financial, medical or otherwise); do not use it for regulated professional purposes without qualified human oversight.
- You retain rights to the content you input. Subject to these Terms and to the rights of third parties, you may use the websites you generate for lawful purposes.
- We may moderate content: remove or restrict content that violates these Terms, refuse or filter AI outputs, and suspend accounts that violate these rules.
- If you believe content on the Service infringes your rights, contact our support team. We will investigate, may remove or restrict the reported content, and may suspend or terminate accounts for repeated infringement.
6. Credits, plans and subscriptions
The Service is provided through free and paid plans. Credits are consumed when generating or editing websites, at the rates shown on the pricing page. Free credits refill periodically; paid plans include a monthly credit allowance. Credits are personal to your account, have no cash value and are not transferable.
7. Payment, billing and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing, taxes, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically each month until cancelled; you may cancel at any time. Refunds are handled in accordance with our Refund Policy.
8. Intellectual property
Sitely retains all rights, title and interest in the Service, including its software, models, documentation, design and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you selected, solely for its intended purpose. You grant us a limited licence to host and process your prompts and generated content solely as needed to provide the Service to you.
9. Service availability
We do not guarantee that the Service will be uninterrupted, timely or error-free. Maintenance, third-party outages or other events may temporarily affect availability.
10. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. If your access ends, your projects become inaccessible — download any content you wish to keep beforehand.
11. Disclaimers and liability
The Service is provided "as is" without warranties of any kind, and all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability to you is capped at the fees you paid us in the twelve months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is not permitted by law.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. General
- These Terms are governed by the laws of Spain, where the Seller (Bouchra Khalifa, trading as Sitely) is established, and the courts of Spain have exclusive jurisdiction over disputes.
- We may update these Terms from time to time; the current version is always published on this page.
- You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition.
- Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure).
